Terms and Conditions

1. Validity

These General Terms and Conditions apply to all services provided by Gebrauchskonzept to clients (B2B & B2C), in particular usage, space, and process concepts. Deviating terms and conditions apply only with written consent.

2. Services

Conceptual consulting/documentation; no construction work, no architectural/engineering services. Deliverables: Written concepts, photo documentation if necessary; drawings only if expressly stated in the offer.

3. Obligation to cooperate

The client shall provide all required information/documents completely and correctly and shall name a contact person.

4. Offer & Contract

Offers are valid for 14 days. The contract is concluded upon acceptance/order in text form.

5. Remuneration & Payment

Prices are based on the selected package (Basic/Pro/Premium) or individual offer. Payment is due within 7 days of the invoice date, unless otherwise agreed. In case of late payment, statutory default interest applies.

6. Rights of use

Upon full payment, the client receives a non-exclusive, non-transferable right of use for internal use. Distribution to third parties or publication only with prior consent.

7. Changes/additional services

Requests for changes after concept approval or beyond the agreed scope will be charged based on the effort involved or with additional flat rates.

8. Liability

Liability is limited to intent and gross negligence; in cases of simple negligence, liability is limited only to breaches of essential contractual obligations (cardinal obligations) and to foreseeable damages typical for the contract. No liability is assumed for incorrect or incomplete information provided by the client.

9. Reference

The usage concept may use the name and project title as a reference (logo/details only with consent). Objection is possible at any time.

10. Final provisions

German law applies. Place of jurisdiction – to the extent permissible – is Cottbus. Should individual provisions be invalid, the remainder of the contract shall remain valid.
